Impeachment Motion Filed Against Justice Shekhar Kumar Yadav in Rajya Sabha Over Controversial Speech
A motion for the impeachment of Justice Shekhar Kumar Yadav, a Judge of the Allahabad High Court, was submitted to the Rajya Sabha today. The motion, signed by 55 Members of Parliament, surpasses the 50-MP threshold required to initiate an impeachment.
The motion was submitted by a delegation led by senior lawyer Kapil Sibal, which also included MPs Vivek Tankha, Digvijaya Singh, P. Wilson, John Brittas, and K.T.S. Tulsi. It calls for Justice Yadav’s impeachment over his speech at a Vishwa Hindu Parishad (VHP) event in Prayagraj last Sunday.
The impeachment motion accuses Justice Yadav of making inflammatory remarks that targeted minority communities. Specifically, it references his statement that the country should be governed by the will of the majority, his derogatory comments about Muslims, and his controversial use of the term "Kathmulla." Additionally, the motion highlights his remark that Muslim children, due to their exposure to animal slaughter, are incapable of exhibiting kindness.
The motion argues that these comments violate Justice Yadav's oath of office and undermine the secular values enshrined in India's Constitution. Furthermore, it states that such divisive statements harm public trust in the judiciary, erode confidence in its impartiality, and damage the judiciary’s credibility as a neutral body protecting the rights of all citizens.
Under Articles 124(4) and 124(5) of the Constitution, a judge can be removed from office for actions that damage judicial ethics, impartiality, and public confidence. This motion follows multiple complaints submitted to Chief Justice of India, Sanjiv Khanna, prompting the Supreme Court to request a report from the Allahabad High Court regarding Justice Yadav’s controversial speech.
